Romby Terms of Service

Draft — under legal review. These Terms describe how the service works today in plain language. They have not yet been finalised by a lawyer — treat them as accurate and in effect, not as polished final legal text.

These Terms govern your use of the Romby eater app (app.romby.co) and the Romby Coach coach dashboard (dashboard.romby.co), together "Romby" or "the Service", operated by Evgeny Klimenchenko ([COMPANY NAME], [REGISTERED ADDRESS] — to be updated upon incorporation). By creating an account or using Romby, you agree to these Terms and to our Privacy Policy (and, if you're a coach, our Coach Data Processing Agreement).

1. The service

Romby lets you log meals from photos (using AI calorie/macro estimation), track water, weight and streaks, and receive nudges from an in-app AI coach. Human coaches can additionally use Romby Coach to invite clients, assign goals, and track their real logged data.

2. Accounts

  • Romby is currently invite-only — you need an invite from an existing user, a coach, or us to create an account.
  • You must be at least 16 years old to use Romby.
  • You're responsible for keeping your credentials confidential and for activity on your account.
  • One account should represent one real person (family-sharing / view-only access for a household is supported as a distinct feature, not a shared login).
  • Minimum password length is 8 characters, and we cap login attempts to slow down guessing.

3. Acceptable use

You agree not to:

  • Use Romby for anyone else's account without permission.
  • Upload content you don't have the right to share, or that's unlawful, abusive, or infringing.
  • Attempt to access another user's data without their consent, or bypass the invite/consent gates described in the Privacy Policy.
  • Reverse-engineer, scrape, or interfere with the Service's normal operation.
  • Resell or white-label the Service without our written agreement.

4. Health disclaimer

Romby is not medical advice. The calorie and macro estimates you see — whether from our AI vision model, barcode lookups, or the in-app AI coach's suggestions — are approximate and for informational purposes only. They are not a substitute for professional medical, dietary, or psychological advice, diagnosis, or treatment. Always consult a qualified healthcare professional before making decisions about your diet, weight, or health, especially if you have or suspect you may have an eating disorder, a medical condition, or are pregnant or nursing.

5. The coach–client relationship

Romby is a technology platform that connects coaches and clients, gives coaches visibility into a client's real logged data once the client consents, and — as described in §6 — operates the payment rails a client uses to pay their coach. Romby is not a party to the coaching relationship itself: we don't supervise, review, or guarantee the coaching advice a coach gives. A coach is not Romby's employee or agent, and Romby does not vet, certify, or guarantee any coach's qualifications, credentials, or advice. Clients choose and evaluate their own coach.

6. Payments

Romby operates a marketplace: a coach who wants to charge for coaching sets a monthly price, and a client subscribes and pays through Romby-hosted Stripe Checkout. By subscribing, a client authorises recurring monthly charges until they cancel. Romby takes a platform (application) fee of 15% from each charge; the remainder is paid to the coach via their own Stripe Connect Express account, which the coach sets up and controls. The eater app itself is free — Romby does not charge individual users for logging food, water, or weight. Stripe processes and stores the payment method; Romby stores only the card brand and last 4 digits for the client's receipt/membership screen (see the Privacy Policy). Refunds, if any, follow the policy shown at checkout; otherwise handled case-by-case via hello@romby.co.

7. Your content

You own the photos, notes, and other content you upload. By uploading it, you grant Romby a licence to store, process (including sending photos and typed food descriptions to our AI providers, see the Privacy Policy), and display it back to you — and, if you've connected a coach, to them — solely to provide the Service.

8. Intellectual property

The Romby name, logo, mascot, and app design are owned by Evgeny Klimenchenko / [COMPANY NAME]. You may not copy or reuse them without permission.

9. Termination

You can stop using Romby and request account deletion at any time (§6 of the Privacy Policy). We may suspend or terminate an account that violates these Terms, is used fraudulently, or where a coach's invite/subscription lapses. On termination, the data-retention rules in the Privacy Policy still apply.

10. Disclaimers & limitation of liability

Romby is provided "as is". AI-generated estimates can be wrong; we don't guarantee their accuracy. To the maximum extent permitted by law, Romby and its operator are not liable for indirect, incidental, or consequential damages arising from your use of the Service, including decisions made based on calorie/macro estimates or coaching advice. Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g. for death, personal injury caused by negligence, or fraud).

11. Governing law

These Terms are governed by [GOVERNING LAW / JURISDICTION], without prejudice to any mandatory consumer-protection or data-protection rights you have under the law of your country of residence within the EU.

We'll update the "last updated" date above when we change these Terms, and flag material changes in-app or by email.
